TERMS AND CONDITIONS
Terms and Conditions
Eliza & Lea · Last updated: 9 October 2026
These Terms and Conditions apply to every purchase made through the Eliza & Lea website (www.eliza-lea.com). By placing an order, you agree to the terms set out below.
1. Applicability
By placing an order through our website, you agree to these Terms and Conditions. Eliza & Lea is a trading style of DGTL-ASPECT. We may update these terms from time to time; the version in effect at the time of your order applies to that purchase.
In these Terms and Conditions, “the entrepreneur” means Eliza & Lea (DGTL-ASPECT) and “the customer” means the person who places an order. These general terms and conditions apply to every offer by the entrepreneur and every concluded distance contract. Before the agreement is finalized, the terms are made available electronically or otherwise.
2. Product Information
We do our best to display our products, materials, and colours accurately. Actual colours may vary slightly depending on your screen settings, and product images are for illustrative purposes. We reserve the right to correct minor typographical errors.
3. Ordering and Payment
The offer clearly specifies total costs, including shipping fees, customs duties, and any additional charges collected by the postal or courier service.
An order is confirmed once full payment has been successfully received. We accept Visa, Mastercard, Apple Pay, Google Pay, Shop Pay, and other methods shown securely at checkout.
4. Processing and Delivery
- Processing time: 1–3 business days.
- Estimated delivery: 10–20 business days, depending on your location within Australia.
- Fulfilment: To bring you a curated collection at fair prices, orders are fulfilled by our trusted international partners and shipped directly to the address you provide.
- Import terms: Orders are shipped under terms that make the customer the recipient and responsible party for any import-related processes. The entrepreneur ensures that products are dispatched in compliance with international shipping regulations but bears no responsibility for delays or issues arising during customs clearance. Any failure by the customer to comply with import obligations does not constitute grounds for cancellation or refund of the order.
- Delays: Delivery may occasionally take longer during peak periods, extreme weather, or due to customs processing.
5. Returns, Cancellations, and Refunds
We want you to be happy with your purchase. Change-of-mind returns are accepted within 30 days of delivery, subject to the following:
- Process: Contact us at info@eliza-lea.com first to receive return authorisation and instructions.
- Return address: By placing an order, you agree that approved returns will be shipped to our designated international return facility at:
-
Zhou Yifeng
4/F, Building 9, Elevator 1, Rongchen Zhigu High‑Tech Industrial Park,
No.49 Jinfu 2nd Road, Liaobu Town,
Dongguan City, Guangdong Province,
P.R.China
Postal Code: 523400
Phone: +86 13302615887 - This address is also confirmed in the return authorisation email you receive and in our Returns & Refunds policy. Returns sent without prior authorisation, or to another address, can't be processed.
- Return costs: For change-of-mind returns, return shipping and any related customs or postal charges are the customer's responsibility. We recommend a trackable shipping method, as we can't issue a change-of-mind refund for a return lost in transit.
- Condition: Returned items must be unused, unwashed, and in their original packaging.
6. Liability
Once tracking confirms an order has been delivered to the address you provided, Eliza & Lea is not liable for its loss, theft, or damage. It's your responsibility to make sure your delivery details are correct when ordering; any address correction must be reported to us within 24 hours of placing your order. Nothing in this section limits any consumer guarantee you're entitled to under Australian law.
7. Customs, Import Duties, and VAT Liability
7.1 All goods offered and sold through this website are shipped under the delivery term Delivered At Place (DAP), formerly known as Delivered Duty Unpaid (DDU), as defined under the Incoterms® 2020, with import duties and taxes unpaid. This means that the customer is solely and fully responsible for all costs and obligations arising from the importation of the goods into the destination country.
7.2 Such obligations include, but are not limited to:
- (a) payment of import duties, value-added tax (VAT) or goods and services tax (GST), and other taxes or levies applicable at the point of entry;
- (b) customs clearance costs, including any brokerage, inspection, or handling fees imposed by customs authorities, postal carriers, or courier services; and
- (c) compliance with local laws, product regulations, restrictions, and required certifications in the country of delivery.
7.3 The seller (referred to as “the entrepreneur”) does not act as the importer of record for any order; the customer acts as the importer. Legal title and responsibility for the goods transfer to the customer upon shipment. The entrepreneur is not liable for any delays, seizures, refusals, or fines arising from the customer’s failure to comply with applicable import laws or settle required fees.
7.4 The entrepreneur provides the necessary commercial documentation for international shipment (including, where required, a pro forma or commercial invoice, product description, and declared value). However, the entrepreneur does not guarantee that the documentation or goods will meet specific regulatory or technical import requirements in the country of destination. The customer is solely responsible for verifying whether the ordered goods are permitted for import, restricted, or require special permits or licenses.
7.5 The customer agrees to indemnify and hold the entrepreneur harmless from any financial consequences, claims, penalties, or charges imposed by customs authorities or third parties as a result of the customer’s non-compliance with applicable import regulations.
7.6 It is strongly advised that customers contact their local customs authority or consult relevant import guidelines prior to placing an order, to avoid any unexpected charges, delays, or refusals at the border.
8. CESOP Compliance
From 2024, payment service providers will register transaction data in the CESOP system (Central Electronic System of Payment Information) as per EU regulations. The entrepreneur complies with these regulations, which may impact the monitoring and reporting of payments.
9. Intellectual Property
All content on this website — including text, product descriptions, graphics, images, and logos — belongs to Eliza & Lea and may not be copied or used without our prior written permission.
10. Complaints and Dispute Resolution
We take complaints seriously. You can submit one via our contact form or by emailing info@eliza-lea.com. We aim to respond and offer a fair resolution within 5 business days.
11. Governing Law
These terms and conditions are governed by Dutch law. Disputes will preferably be resolved amicably. If necessary, disputes will be submitted to the competent court in the Netherlands. Nothing in this clause limits any right you may have to bring a claim in your own state or territory under the Australian Consumer Law.
12. Your Rights Under Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded. If your order is faulty, not fit for purpose, or significantly different from how it was described, you're entitled to a repair, replacement, or refund, and we'll also cover reasonable return shipping in that case — regardless of the change-of-mind terms in Section 5.
If any part of these Terms conflicts with your rights under the ACL, your ACL rights take priority.
